Throughout these Terms, “Pool Genie,” “we,” “us,” and “our” refer to Pool Genie. “You” and “your” refer to the customer, website visitor, purchaser, or other person using our website or services.

By accessing our website, placing an order, requesting services, or otherwise using our website or services, you agree to these Terms.

If you do not agree to these Terms, please do not use our website or purchase products or services through it.

1. ELIGIBILITY

By using our website or purchasing products or services from Pool Genie, you represent that you are legally capable of entering into a binding agreement.

Certain products, including pool chemicals or other regulated materials, may be subject to additional age, shipping, handling, or geographic restrictions.

We reserve the right to refuse or cancel a transaction when necessary to comply with applicable laws, regulations, carrier requirements, manufacturer restrictions, or safety requirements.

2. ONLINE STORE TERMS

Pool Genie sells swimming pool and spa products that may include:

Pool chemicals and water-treatment products;

Pumps and motors;

Filters and filter components;

Heaters and related equipment;

Automatic and manual pool cleaners;

Saltwater pool equipment;

Automation and control equipment;

Replacement parts;

Maintenance equipment;

Testing products;

Pool accessories; and

Other pool and spa products.

Product availability may change without notice.

We reserve the right to limit quantities, discontinue products, restrict sales, or refuse orders when reasonably necessary.

3. PRODUCT INFORMATION

Pool Genie makes reasonable efforts to provide accurate product descriptions, photographs, specifications, compatibility information, pricing, and other information.

However, manufacturers may modify packaging, labeling, formulas, specifications, designs, colors, dimensions, or product features without notice.

Product images are provided for reference and may not always represent the exact packaging or appearance of the product received.

In the event of a conflict between information on our website and the manufacturer’s current instructions, labeling, specifications, or safety information, the manufacturer’s current information should be followed.

4. PRICING & ERRORS

We make reasonable efforts to ensure that prices and product information are accurate.

However, typographical errors, pricing errors, incorrect product descriptions, inventory errors, or other mistakes may occasionally occur.

Pool Genie reserves the right to correct errors and to cancel or refuse an order affected by an obvious pricing, inventory, or product-information error.

If payment has already been collected for an order we cancel, the applicable amount will be refunded to the original payment method.

Prices may change without notice.

5. ORDERS

Submitting an order does not necessarily mean that Pool Genie has accepted the order.

We reserve the right to verify information and refuse or cancel orders for legitimate business, safety, fraud-prevention, inventory, shipping, regulatory, or payment-related reasons.

An order may also be cancelled if:

A product is unavailable;

Payment cannot be authorized;

An obvious pricing or listing error occurred;

The shipping destination is not serviceable;

Carrier restrictions prevent shipment;

A hazardous product cannot legally or safely be shipped to the destination; or

We reasonably believe an order involves fraud or misuse of our website.

If we cancel a paid order, we will issue an appropriate refund.

6. PAYMENT

Payment is due according to the terms displayed during checkout or otherwise communicated for the applicable service.

You agree to provide current, complete, and accurate billing and payment information.

By submitting payment information, you represent that you are authorized to use the payment method provided.

8. SHIPPING & DELIVERY

Delivery dates are estimates unless expressly guaranteed.

Pool Genie is not responsible for reasonable delays caused by circumstances outside our control, including:

Carrier delays;

Severe weather;

Natural disasters;

Transportation interruptions;

Manufacturer or distributor delays;

Supply shortages;

Incorrect customer-provided addresses;

Government actions; or

Other circumstances beyond our reasonable control.

Additional restrictions may apply to hazardous materials, oversized equipment, freight shipments, and certain pool chemicals.

Customers are responsible for providing complete and accurate shipping information.

Our separate Shipping Policy may contain additional terms and is incorporated into these Terms by reference.

9. HAZARDOUS MATERIALS & POOL CHEMICALS

Some products sold by Pool Genie are hazardous materials or require special handling.

By purchasing pool chemicals, you agree to:

Read and follow all manufacturer labels and instructions;

Review applicable warnings and safety information;

Use products only for their intended purpose;

Store chemicals safely and securely;

Keep chemicals away from children and animals;

Avoid mixing incompatible chemicals;

Use appropriate protective equipment when required;

Follow applicable disposal requirements; and

Comply with applicable laws and regulations.

Never mix pool chemicals unless the product manufacturer specifically instructs you to do so.

Different chlorine products, acids, oxidizers, and other pool chemicals may react dangerously when improperly combined.

Pool Genie is not responsible for injury, property damage, equipment damage, chemical reactions, fires, fumes, explosions, environmental damage, or other losses resulting from misuse, improper storage, improper handling, unauthorized mixing, or failure to follow manufacturer instructions.

Nothing in these Terms excludes liability that cannot legally be excluded.

10. PRODUCT COMPATIBILITY

Pool equipment and replacement parts may vary according to manufacturer, model, year, horsepower, voltage, plumbing configuration, software version, and other specifications.

Customers are responsible for verifying compatibility before purchasing equipment or replacement parts.

We encourage customers to contact Pool Genie before ordering if they are uncertain about compatibility.

Any compatibility guidance provided by Pool Genie is based on the information available to us and the information provided by the customer.

The manufacturer’s specifications ultimately control.

11. INSTALLATION & REPAIRS

Certain products sold through Pool Genie may require professional installation.

Electrical equipment, gas heaters, pumps, automation systems, plumbing components, and other products should be installed according to manufacturer requirements and applicable building, electrical, plumbing, gas, safety, and permitting requirements.

Customers are responsible for determining whether professional installation, permits, inspections, or licensed contractors are required.

Pool Genie is not responsible for damage caused by improper installation, unauthorized modification, improper wiring, improper plumbing, improper electrical service, misuse, or installation contrary to manufacturer instructions.

Where Pool Genie separately performs installation or repair services, the terms applicable to that service will control the work performed by Pool Genie.

12. MANUFACTURER WARRANTIES

Products sold by Pool Genie may include warranties provided by their manufacturers.

Manufacturer warranty coverage varies by product and manufacturer.

Pool Genie does not expand, modify, or replace a manufacturer’s warranty unless we expressly agree to do so in writing.

Certain warranties may require:

Professional installation;

Installation by an authorized dealer;

Product registration;

Proof of purchase;

Specific maintenance procedures; or

Compliance with other manufacturer requirements.

Customers should review the manufacturer’s warranty before installing or using equipment.

Pool Genie may assist with warranty information when reasonably possible, but warranty claims remain subject to the manufacturer’s requirements and approval.

13. RETURNS & REFUNDS

Returns, refunds, cancellations, damaged products, and non-returnable merchandise are governed by the Pool Genie Return & Refund Policy, which is incorporated into these Terms by reference.

Certain products, particularly hazardous pool chemicals, opened chemicals, installed equipment, used equipment, special-order products, and custom products, may not be eligible for return.

Customers should review the Return & Refund Policy before purchasing.

14. LOCAL POOL SERVICES

In addition to online product sales, Pool Genie may provide services including:

Pool cleaning;

Routine maintenance;

Water testing and chemical balancing;

Equipment inspection;

Troubleshooting;

Equipment repair;

Equipment replacement;

Pool opening or closing services;

Green-to-clean services; and

Other pool-related services.

Availability varies by location and service area.

Requesting a quote or submitting a service request does not guarantee that Pool Genie will accept the job.

15. SERVICE ESTIMATES & QUOTES

Unless expressly stated otherwise, estimates and quotes are based on the information reasonably available at the time they are prepared.

Additional problems may become apparent after work begins.

Examples include:

Hidden leaks;

Damaged plumbing;

Failed valves;

Electrical problems;

Internal equipment damage;

Improper previous repairs;

Structural problems;

Severe water chemistry conditions; or

Additional replacement parts that could not reasonably be identified beforehand.

If additional work is necessary, Pool Genie may provide an updated estimate or request customer authorization before performing substantial additional work.

Quotes may expire after the period stated on the quote.

16. CUSTOMER RESPONSIBILITIES FOR SERVICE

Customers receiving on-site pool services agree to provide reasonable and safe access to the pool and applicable equipment.

Customers should disclose known hazards, including:

Aggressive animals;

Unsafe electrical conditions;

Damaged structures;

Locked or inaccessible areas;

Known chemical hazards; and

Other conditions that could reasonably affect technician safety.

Pool Genie may decline or discontinue service when conditions present an unreasonable safety risk.

17. WATER CHEMISTRY & POOL CONDITIONS

Pool water conditions can change because of weather, temperature, rainfall, sunlight, swimmer load, contamination, equipment failure, water source, chemical additions, landscaping, and other factors outside Pool Genie’s control.

Pool Genie does not guarantee that water chemistry will remain at a particular level between service visits.

Customers should contact us if they notice significant water-quality changes, equipment failures, leaks, unusual odors, discoloration, or other potentially unsafe conditions.

18. SERVICE SCHEDULING

Service dates and arrival windows may be estimates unless otherwise expressly agreed.

Weather, emergencies, equipment availability, traffic, customer access, technician scheduling, or other circumstances may require Pool Genie to reschedule service.

We will make reasonable efforts to communicate material scheduling changes.

19. WEBSITE ACCOUNTS

If our website allows customer accounts, you are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You agree to provide accurate information and promptly notify Pool Genie if you believe your account has been accessed without authorization.

20. ACCEPTABLE USE

You may not use the Pool Genie website to:

Violate applicable law;

Commit or facilitate fraud;

Interfere with website security or functionality;

Introduce malware or malicious code;

Attempt unauthorized access to systems or accounts;

Scrape or harvest information through unauthorized automated means;

Impersonate another person;

Submit false information; or

Engage in conduct intended to damage Pool Genie, our customers, or our service providers.

We may restrict access to our website when we reasonably believe these Terms have been violated.

21. INTELLECTUAL PROPERTY

Unless otherwise stated, Pool Genie’s website content—including original text, graphics, logos, branding, photographs, website design, and other original materials—is owned by Pool Genie or used with permission and is protected by applicable intellectual-property laws.

Manufacturer names, logos, product images, trademarks, and other materials remain the property of their respective owners.

You may use our website for personal and lawful shopping or informational purposes.

You may not reproduce, distribute, commercially exploit, or misrepresent Pool Genie-owned content without permission.

22. REVIEWS & CUSTOMER CONTENT

If you submit reviews, photographs, comments, testimonials, or other content to Pool Genie, you represent that you have the right to provide that content and that it does not violate another person’s rights.

You grant Pool Genie a non-exclusive, royalty-free license to use content you intentionally submit for publication in connection with operating and promoting our business, subject to applicable law.

We reserve the right to remove content that is fraudulent, unlawful, abusive, misleading, or otherwise inappropriate.

23. THIRD-PARTY SERVICES & LINKS

Our website may contain links to or integrations with third-party websites and services.

These may include manufacturers, payment processors, shipping carriers, social-media platforms, financing providers, or other service providers.

Pool Genie does not control and is not responsible for the independent content, terms, security, or privacy practices of third-party websites.

25. DISCLAIMERS

Product performance may vary depending on installation, pool conditions, maintenance, water chemistry, environment, and other circumstances.

Manufacturer warranties and other rights that cannot legally be disclaimed remain unaffected.

26. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pool Genie will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use or misuse of products, website services, or information provided through our website.

This includes, where legally permitted, losses arising from:

Improper chemical handling or storage;

Failure to follow product instructions;

Improper installation;

Incorrect customer-provided information;

Use of incompatible equipment or parts;

Unauthorized product modifications; or

Circumstances outside Pool Genie’s reasonable control.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

27. INDEMNIFICATION

To the extent permitted by law, you agree to indemnify and hold Pool Genie harmless from third-party claims, damages, liabilities, and reasonable expenses resulting from your unlawful use of our website, violation of these Terms, or misuse of products purchased from Pool Genie.

This provision does not apply to claims arising from Pool Genie’s own conduct where liability cannot legally be shifted to the customer.

28. GOVERNING LAW

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles, except where federal law or another applicable law requires otherwise.

Any dispute regarding these Terms will be handled in accordance with applicable law.

29. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

30. NO WAIVER

Pool Genie’s failure to enforce a provision of these Terms does not waive our right to enforce that provision in the future.

31. CHANGES TO THESE TERMS

Pool Genie may update these Terms periodically to reflect changes in our website, products, services, business practices, or applicable requirements.

Updated Terms will be posted on our website with a revised “Last Updated” date.

Changes will apply prospectively unless otherwise required by law.

32. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy, and any additional terms presented in connection with a particular product or service, constitute the applicable agreement between you and Pool Genie concerning use of our website and purchases made through it.

Separate written service agreements, estimates, invoices, or contracts may contain additional terms applicable to local Pool Genie services.
